2022: NBA Constitutes Zonal Election Appeal Committees [FULL LIST]
The President of the Nigerian Bar Association Olumide Akpata has constituted an Election Appeal committee to resolve issues arising from the 2022 elections.
The National Election Appeals Committee is to receive and resolve complaints and disputes arising from the conduct by the ECNBA, of the National Executive Committee and Representatives of the NBA in the General Council of the Bar.
While the Branch Election Appeals Committees are to receive and resolve complaints and disputes, from their respective Zones, arising from the conduct by the various Branch Electoral Committees, of the Branch Executive Committees.
This was disclosed in a statement signed by the President Olumide Akpata, made available to The Lawyer by the National Publicity Secretary, Dr Rapulu Nduka.
According to the statement, this is in preparation for the forthcoming elections into the National Executive Committee of the Nigerian Bar Association (NBA), and the Executive Committee of various NBA Branches, the leadership of the Nigerian Bar Association has constituted the NBA Election Appeal Committees for the NBA National Election and various NBA Branch elections.
The statement reads: “By a combined reading of the provisions of Section 14 (1) (l) and Section 14 (2) (l) of the NBA Constitution 2015 (as amended in 2021) (the NBA Constitution) as well as Part IX of the Second Schedule to the NBA Constitution, the appellate powers hitherto vested in the Electoral Committee of the Nigerian Bar Association (ECNBA) have been taken away and are now vested in the newly established National Election Appeal Committee under the NBA Constitution.
The National Election Appeal Committee is to receive and resolve complaints and disputes arising from the conduct, by the ENCBA, of election of National Officers and election of the representatives of the NBA in the General Council of the Bar, both of which elections are scheduled to hold in July 2022.
“In the same vein, Section 14 (1) (m) and Section 14 (2) (m) of the NBA Constitution as well as Paragraph 17.5 of the Third Schedule to the NBA Constitution, vest in the Branch Election Appeals Committees, the powers to hear and determine appeals arising from elections into the various Branch offices conducted by the various Branch Election Committees Pursuant to the foregoing, and by virtue of the powers vested in me under Section 14 (3) of the NBA Constitution, I hereby constitute the following Election Appeal Committees subject to the ratification of the NBA National Executive Council.”
