Bail simply means temporary release from custody while awaiting trial.
It does not mean the case has ended. It only means the accused person is allowed to go home under certain conditions.
Is Bail Automatic?
Not always.
There are two major types:
1. Police Bail
This happens before the case goes to court. The police may release a suspect on certain conditions.
2. Court Bail
Once the case is in court, the judge decides whether to grant bail.
When Can Bail Be Refused?
Bail may be denied if:
-
The offence is very serious (e.g., capital offences)
-
The accused may interfere with witnesses
-
The accused may flee the country
-
The accused may commit another offence
Is Bail Free?
Legally, bail is free.
However, you may need a surety (someone who guarantees your appearance in court).
If anyone demands money for “bail processing,” that is unlawful.
