Prof. Ojukwu SAN Questions Propriety Of Emefiele’s Case Before Federal High Court
Renowned Law Professor and a Former Deputy Director-General of the Nigerian Law School, Prof. Ernest Ojukwu SAN has asked questions pertaining to the suit instituted by the Governor of the Central Bank of Nigeria at the Federal High Court Abuja.
In his action which came before the Federal High Court Abuja on Monday, Emefiele through his Counsel, Mike Ozekhome SAN is seeking a declaration of the Court qualifying as eligible to run for the office of President under the All Progressives Congress as well as to restrain the Defendants from disqualifying him from contesting the said election.
In a Twitter post apparently in reaction to the Suit, Ernest Ojukwu wondered if the suit which questions the validity and constitutionality of the CBN Governor’s continued employment as the Head of the Apex bank even as he pursues his political ambition is not supposed to come before the National Industrial Court of Nigeria.
He also sought to know who should be proper Defendants in the suit by virtue of who suffers or feels the paon if a public officer fails to resign before contesting an election.
He tweeted: “Pls help me learn. Can a suit connected to EMPLOYMENT even if summons on S.84 Electoral Act be heard by FHC or NICN? Who should it be paining that somebody in public office has not resigned- Employer’s Board, Political Party? Or AGF? I just want to know.
