Court Orders Firm to Stop Ongoing Construction in Alade Market

Justice Raliat Adebiyi of a Lagos High Court sitting in Ikeja has ordered the Executive Chairman, Masters Reality International Concepts Limited, to stop construction on Alade Market in Allen Avenue, Lagos, pending the determination of the suit before her.

The judge gave the order in a suit filed by Mr. Gbenga Ajala on behalf of Alli Isiba family.

The lawyer had filed an interlocutory injunction against Ikeja Local Council over the construction.

The claimants in the suit, Mrs. Adenike Isiba-Kasali, Chief Ligali Adebayo Isiba and Mr. Saheed Adogoke Isiba, appeared for themselves and as representatives of the Alli Isiba family of Itire.

In granting the order, Justice Adebiyi ordered that all parties should cease further construction or activities on the property.

She subsequently adjourned to October 11, 2022, and directed parties to appear for the hearing.

The Alli Isiba family of Itire had filed the application pursuant to Order 38, Rule 8 and Order 39, Rule 3 and 8 of the Lagos State (Civil Procedure Rules) 2012.

Earlier during the proceedings, Ajala told the court that his application was supported by a 29-paragraph affidavit deposed to by the Head of the Alli Isiba family.

He is asking the court to determine whether, given the circumstances of the case, it is not just and equitable that order of interlocutory injunction is made restraining the defendants from further trespassing on the land of the family at Alade Village, Ikeja, Lagos State covered by a Deed of Conveyance dated September 23, 1977, and registered as No. 61, at Page 61, in Volume 1657 in the Register of Deeds in the Land Registry, Ikeja, pending the determination of this suit.

Counsel to Ikeja Local Council informed the court that his client, which contracted the service of Masters Reality International Concepts Ltd to develop the Alade Market, had withdrawn the contract agreement with him and henceforth, he does not represent its interest in the market.

The judge, after entertaining submissions of the counsel, subsequently ordered Masters Reality International Concepts Ltd to stop construction and withdraw services.
